Definitions

'Personal Data' shall mean any information relating to an identified or identifiable natural person and any information regarding the usage of Nuance products and/or services ('Data Subject'). An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to one’s identity.

Use of Personal Data

All products and all studies, reports, analyses and other data, information or materials created in whole or part using Personal Data shall be and remain the sole property of Nuance. None of the Personal Data will be returned to you.

As its proprietary information, Nuance intends to keep the Personal Data confidential.

Furthermore, Nuance intends to use the Personal Data for the purpose of developing and enhancing the Software, future versions of the Software and/or related or similar software, as well as for (direct) marketing purposes for Nuance products and/or services or those of third parties. The user agrees that Personal Data may be transferred to third parties.

The voluntary policies that Nuance intends to follow to maintain the confidentiality of the Personal Data include the following: (a) sharing the Personal Data only with employees, agents, consultants, or officers of Nuance or third parties with a need to know to carry out the Purpose ("Authorized Persons"), and (b) requiring such Authorized Persons to enter into written confidentiality agreements with Nuance when, in Nuance's sole judgment, such written confidentiality agreements are necessary to safeguard the confidentiality of the Personal Data.

PLEASE NOTE, HOWEVER, that Nuance's handling or treatment of the Personal Data in accordance with this Section 1 is entirely voluntary and, therefore, NUANCE WILL HAVE NO LIABILITY TO YOU OR ANY OTHER PARTY FOR FAILURE TO KEEP THE PERSONAL DATA CONFIDENTIAL OR TO OTHERWISE HANDLE OR TREAT THE PERSONAL DATA IN ANY MANNER.

Transfer to third countries

The user agrees that Personal Data may be transferred to third countries, inside and outside of the European Union even if the level of protection is not to the same degree as under the European Regulations.

Rights of the Data Subject

The Data Subject has a right of access to the Personal Data processed by Nuance and is entitled to request rectifications thereto.

The Data Subject has a right to withdraw its consent to usage of the Personal Data for (direct) marketing purposes. The Data Subject however acknowledges that as a result, the Data Subject shall refrain from using the Nuance product and/or service ion question without Nuance bearing any obligation, liability or responsibility.

The Data Subject agrees that the Personal Data may also include special categories of data such as, but not limited to, data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, and data concerning health or sex life. The user hereby gives his explicit consent to process any such data.
